PayPal Express Checkout Problem: Can't Agree to Terms

Hi,

I’ve in Magento Terms & Condition enabled during checkout, but when someone uses PayPal express checkout there is no check box to agree with the Terms & Conditions. As a result, the checkout can’t be completed. As a temporary solution, I disabled Terms & Conditions. But, I must have it back ASAP.

Attached you can see a screenshot of error. This error shows after PayPal sends the client back to the website to complete the order.
